2010

 

1. Jorge Solis-Palma

Age: 28
Nationality: Mexican
Cause of Death:Fatal shooting
Incident Date: 1-4-2010
Incident Location: Douglas, Az.

Border Patrol agents spotted three men traveling north near the border fence. The men separated. Several agents pursued Jorge Alfredo Solis-Palma. He allegedly got into a physical altercation with an agent and then escaped. As he ran, the agent pursued and fatally shot Solis-Palma.

 

2. Victor Santillan de la Cruz

Age: 36
Nationality: Mexican
Cause of Death: Fatal Shooting

Incident Location: Texas

A Border Patrol agent shot Santillan de la Cruz after he was apprehended on U.S. side of the Rio Grande allegedly transporting drugs.

3. Neil Begin

Age: 54
Nationality: U.S.
Cause of Death: Fatal shooting
Incident Date: 4-23-2010
Incident Location: Near Van Buren, ME

Border Patrol Agent Robert Kipler, assigned to the Van Buren Station of the Houlton Sector, responded to a residence located just south of Van Buren, to back up a Maine State Trooper investigating an ongoing domestic dispute. Agents entered the residence with the State Trooper and confronted the subject [who] appeared to be holding a bolt-action rifle. The State Trooper and BP agent discharged their weapons at the subject. The subject was struck by some of the rounds fired, and collapsed to the floor. EMS arrived and transported the subject to a local hospital for emergency treatment and later transported by life-flight to a hospital in Bangor, Maine. The subject died the next morning. The Maine State Attorney General’s report later found that Agent Robert Kipler fired 14 shots, and Kipler fired the fatal shot.


4. Anastasio Hernandez Rojas

Cause of Death: Tortured to death by CBP
Incident Date: 5-28-2010
Incident Location: San Diego, Ca.

Border agents apprehended and intended to deport Anastasio Hernandez Rojas, a long time San Diego resident who did not have legal status. While in custody over a dozen agents beat and Tased him to death. His family is now suing the government, there is a pending DOJ investigation, a Grand Jury hearing in process, and U.S. lawmakers have called for an agency wide investigation on the use of force.


5. Sergio Adrian Hernandez-Guereca


Age: 15
Nationality: Mexican
Cause of Death: Fatal shooting
Incident Date: 6-7-2010
Incident Location:  Ciudad Juarez, Mexico

A Border Patrol agent shot Sergio Adrian Hernandez Guereca on the Mexican side of the Rio Grande canal between El Paso and Juarez. Hernandez peeked out from behind a concrete pillar on the Mexican side of the border. The agent claimed the boys were throwing rocks and he fired at Hernandez allegedly in self defense.

 

6. Juan Mendez, Jr.

Age: 18
Nationality: Unknown
Cause of Death: Fatal shooting
Incident Date: 10-5-2010
Incident Location: Eagle Pass, Texas

A Border Patrol agent stopped a truck that Juan Mendez was driving and began to question him. A 15-year-old boy fled the truck, and Mendez allegedly struggled with the agent. He was shot twice and declared dead at the scene. Authorities allegedly found 325 pounds of marijuana in the truck.

7. Ramses Barron Torres

Nationality: Mexican
Cause of Death: Fatal shooting
Incident Date: 1-5-2011
Incident Location: Nogales, Mexico

Barron Torres was allegedly climbing the border fence from Mexico when an agent shot him. He was pronounced dead upon his arrival at a Mexican hospital.

 

8. Roberto Pérez Pérez


Age: 63
Nationality: Mexican
Cause of Death: Lack of medical care after being beaten.
Incident Date: 1-13-2011
Incident Location: San Diego, CA

Pérez Pérez attempted to cross without inspection through the San Ysidro Port of Entry when he was tackled, beaten and Tasered repeatedly by CBP officials.  He was taken into custody and died months later while still in custody due to lack of adequate medical attention. He was charged with allegedly assaulting a federal agent.

 

9. Alex Martinez

Age: 30
Nationality: U.S.
Cause of Death: Fatal shooting
Incident Date: 2-27-2011
Incident Location: Washington State

Martinez family members called 911 requesting medical assistance.  Border Patrol responded to the call and shot Martinez upon seeing him come out of his home with what they believed was a weapon and turned out to be a flashlight.

 

10. Carlos Lamadrid


Age: 19
Nationality: U.S.
Cause of Death: Fatal shooting
Incident Date: 3-21-2011
Incident Location: Douglas, AZ

Lamadrid, a U.S. citizen, was shot in the back by Border Patrol agents while he was climbing the border fence into Mexico. Agents claimed he was throwing rocks and they fired in self defense. He died five hours after the shooting in a hospital. The family has filed a lawsuit.

 

11. Amado Rodriguez

Age: 46
Nationality: Unknown, born in Sinaloa, Mexico
Cause of Death: Fatal shooting
Incident Date: 4-18-2011
Incident Location: Fabens, TX

The Fabens Border Patrol Station was contacted by the El Paso Sheriff’s Office to provide backup for El Paso Sheriff’s deputies on scene. The El Paso Sheriff’s Office SWAT team also arrived on the scene. The El Paso Sheriff’s Department has conducted several investigations into the shooting, including an Internal Affairs investigation . The results of the investigations have not been released, but family members claimed in a new story that the Mr. Rodriguez, who has been in a wheelchair since age 17, was improperly shot by law enforcement agents responding to the scene.

 

12. Jose Alfredo Yañez Reyes


Age: 40
Nationaility: Mexican
Cause of Death: Fatal shooting
Incident Date: 6-21-2011
Incident Location: Tijuana, Mexico

Yañez Reyes was in a tree overlooking the border fence in Mexico when he was shot in the eye by Border Patrol agents on the U.S. side who claimed he was throwing rocks.  He died at the scene.

 

13. Omar Olivares

Age: 28
Nationality: Unknown
Cause of Death: Fatal shooting

Off duty agent got into a shootout with his wife’s cousin. Wife’s cousin was killed at the scene. Agent died later at the hospital from the seven gunshots he had received. It is unknown at this time how the shooting started. According to EPPD approximately 36-38 rounds by both individuals. The subject was shot approximately four times by the agent and he died at the scene. The agent was shot seven times and later succumbed to his injuries and died at the hospital. Subject was transported to the Ft. Duncan Medical Center at which time doctors attempted to revive the subject until all extreme measures and procedures were exhausted by hospital personnel. Subject was pronounced dead by the attending physician.

 

14. Gerardo Rico Lozano

Age: 20
Nationality: Mexican
Cause of Death: Fatal shooting
Incident Date: 11-3-2011
Incident Location: Texas

Rico Lozano was shot and killed after agents pulled over his vehicle on a rural stretch of road. Other occupants and the driver fled, but Lozano allegedly got behind the wheel and drove the vehicle toward the agent. The agent claimed they shot and killed Rico Lozano in self defense.

 

15. Byron Sosa Orellana


Age: 28
Nationality: Guatemalan
Cause of Death: Fatal Shooting,
Incident Date: 12-6-2011
Incident Location: Arizona

Migrants were attempting to cross the border into Arizona when Border Patrol agents encountered them. Sosa Orellana allegedly became combative and an agent shot him in the chest. He died at the scene.

 

2012

16. Alexander Arthur Martin

Age: 34
Nationality: U.S.
Cause of death: Death in vehicle explosion
Incident Date: 3-15-2012
Incident Location: San Diego County

Martin was driving a rental car from Texas to San Diego. He was allegedly driving the wrong way on Interstate 8. Border Patrol agents pursued him and he did not pull over. Agents set up a trap that flattened his car tires. When Martin did not get out of the car, an agent deployed a Taser. The car exploded into flames, killing him.

 

17. Charles Robinson


Age: 75
Nationality: U.S.
Cause of Death: Fatal shooting
Incident Date: 6-23-2012
Incident Location: Maine

Three Border Patrol agents responded to a domestic dispute after receiving a call for help from the Somerset County Sheriff’s Department. Customs and Border Protection said a person in the house opened fire on the agents, who shot back. State police later entered the home and found Charles Robinson dead. The Maine Attorney General is investigating.

 

18. Juan Pablo Perez Santillán

Age: 30
Nationality: Mexican
Cause of Death: Fatal shooting

Incident Location: TX

Santillán was shot and killed for allegedly throwing rocks at a border agent while standing on the Mexican side of the Rio Grande.

 

19. Guillermo Arévalo Pedroza

Age: 37
Nationality: Mexican
Cause of Death: Fatal shooting
Incident Date: 9-3-2012
Incident Location: Nuevo Laredo, México

While patrolling the Rio Grande on a river boat, Border Patrol agents opened fire on a group of men, women and children who were at a family gathering on the Mexican banks of the river. Arevalo Pedraza was struck in the chest and died.

 

20. Valerie Munique Tachiquin-Alvarado


Age: 32
Nationality: U.S.
Cause of Death: Fatal shooting
Incident Date: 9-28-2012
Incident Location: Chula Vista, CA

A plain-clothed Border Patrol agent shot and killed Tachiquin in a residential suburb of San Diego.  The agent alleged she had struck him and was carrying him on top of her car prompting him to fire in self defense. Witnesses tell conflicting stories. The border agent involved had a very troubling record when he worked as a sheriff’s deputy. The Imperial Valley Sheriff’s Department ultimately issued the agent a notice of termination for “unprofessional conduct, dishonesty, violation of or refusal to obey reasonable regulations, insubordination, violation of rules, incompetence and failure to follow proper procedures for arrest, search and seizure and treatment of persons in custody.”

 

21. Border Patrol Agent Nicholas J. Ivie

Nationality: U.S.
Cause of Death: Fatal shooting

Incident Location: Naco, AZ

Ivie was killed by another Border Patrol agent while they were on patrol on horseback. The circumstances are still being investigated.

 

22. José Antonio Elena Rodriguez


Age: 16
Nationality: Mexican
Cause of Death: Fatal shooting
Incident Date: 10-13-2012
Incident Location: Nogales, México

Border Patrol agents who were standing on the U.S. side shot at a group of youth near downtown Nogales, Mexico, after allegedly telling them to stop throwing rocks. Elena Rodriguez was struck with several bullets and died at the scene.  He had been standing in front of a doctor’s office.

 

23. Margarito Lopez Morelos

Nationality: Guatemalan
Cause of Death: Fatal shooting

Incident Location: Baboquivari Mountains on the Tohono O’odham Nation in ArizonaA Border Patrol agent on patrol approximately 12 miles northwest of the Sasabe, Ariz., port of entry encountered an unknown number of individuals who had been in the are. During the encounter, the agent discharged his service issued weapon, resulting in the death of one of the individuals.

The agency did not release a statement until Tucson News Now’s Dan Marries contacted them asking for confirmation following an anonymous tip two days later.

 

2013

24. Mathew Simmons

Age: 27
Nationality: U.S.
Cause of Death: Fatal shooting
Incident Date: 3-21-2013

Incident Location: Otay Mesa Border

Agents drove up to a car on the side of road that appeared to have been in an accident. One of the agents checked the car license plate and determined it was a stolen vehicle. Simmons pulled a handgun on the three agents, shooting one of them in the hip. The agents responded with gunfire and killed him.

25. Ernesto Gutierrez Cortez

Age: 38

Cause of Death: Fatal shooting
Incident Date: 10-19-2013
Incident Location: Otay Mesa, CAAfter CHP conducted a high-speed chase of an individual who was suspected of carjacking, three CBP officials at the port of entry shot at the vehicle killing the driver.

2014

26. Keith J. Martin

Age: 35
Nationality: U.S. Citizen (born in Germany)
Cause of Death: Fatal shooting

Incident Location: Hondo, TX

Border Patrol agent Adam S. Garibay, 33, is suspected of killing his wife’s lover, Keith J. Martin, 35. After beating and tying up his wife in Corpus Christi, Garibay drove to Martin’s home on a private road 3 miles north of Hondo, TX, and allegedly shot him to death.


27. Gabriel Sanchez Velazquez

Nationality: Mexican
Cause of Death: Fatal shooting
Incident Date: 1-16-2014
Incident Location: Near Apache and Portal, AZMan was part of a group Border Patrol was tracking. BP agents took two men into custody without incident, but a third fled and was eventually located “hiding under a mesquite bush” by a federal agent. Reportedly, the man struggled with the agent, attempting to get the federal officer’s weapon, she said. The BP agent, “fearing for his personal safety and potential serious injury, pulled his handgun and fired at the suspect.” The man was struck in the upper body area and “succumbed to his injuries at the scene. Cochise County Sheriff’s Office is leading the investigation.

Incident Location: Otay Mountains, San DiegoAccording to San Diego Sheriff’s, two Border Patrol agents split up to cut off a group of three suspected undocumented immigrants. The two agents were out of sight of each other when one of the agents was struck in the face by a rock thrown by one of the suspects. Fearing for his safety, the agent fired his duty pistol at the man, striking him. 1. Jesus Enrique Castro Romo

Incident Location:  Santa Cruz County, AZ

Castro Romo was shot in the stomach by a Border Patrol agent who alleged he threw rocks. He survived the shooting.

2. Jose Gutierrez Guzman


Age: 41
Nationality: Mexican
Incident: Tased and beaten into a comatose state
Incident Date: 3- 30- 2011
Incident Location: San Luis Port of Entry, AZ

While attempting to enter without inspection Gutierrez Guzman was Tased and beaten.

3.  Hugo Veytia-Quintero

Age: 47
Nationality: Mexican
Incident: Survived shooting
Incident Date: 9-25-2011
Incident Location: San Diego port of entry, CA

Survived after being shot by CBP officials after pulling a fake gun and waving it into the air. Veyta-Quintero had walked through a pedestrian crossing turnstile to enter the U.S. from Mexico without stopping to be processed. CBP agents attempted to handcuff him when he pulled the fake gun out of his belt.

4. Miscarriage of Laura Mireles

Cause of Miscarriage: Physical abuse

Incident Location: Brownsville, Texas

Laura Mireles was driving across the international bridge from Mexico to the US  when was she was stopped and questioned in a parking lot in the U.S. by a U.S. Customs and Border Protection Agent identified only in court documents as Riano. He questioned why she bypassed the x-ray machines for the vehicles when she crossed the border. According to federal court papers, she stayed 10-15 feet away from the agent and only inched closer to watch the agent search her purse. He threw her on the ground, leaned on her with his full weight and threatened  to hit her with an object. Mireles, who is also disabled and has visible malformations on her hands and feet, was handcuffed with such force that the fire department had to be called to remove them. That day she lost her unborn child.

“In this case, U.S. Customs and Border Protection reported, Yuma Sector agents responded to possible bandit activity near a checkpoint on Arizona 85. The agents came across two armed men about 14 miles southwest of Gila Bend, and at least one of the agents fired, hitting one of the armed men, the agency said in a news release.

That man was flown to a Phoenix hospital and is in stable condition; the other man, a Mexican national illegally in the country, was arrested.

It was the latest in a series of shootings by border agents in Arizona – the second this week, the fourth since Oct. 2 and at least the ninth since January 2010.” – Tim Steller, Arizona Daily Star

Incident Location: Laredo, TexasA Border Patrol agent shot and wounded two immigrants after he was assaulted.  According to a news article, agents came across a group of immigrants who had recently crossed the Rio Grande near a train yard along the river east of Laredo’s downtown. One of the agents was assaulted as he tried to apprehend the immigrants, and he opened fire, hitting two of them. An agent and two individuals were taken to a local hospital to be treated for injuries.

Incident Location: Chula Vista, CAAn off-duty U.S. Border Patrol agent opened fire on someone outside a South Bay pharmacy (Rite Aid), after which the targeted person fled in unknown condition. There was no immediate evidence that the gunfire wounded anyone, though the person the federal officer apparently shot at drove away immediately afterward and remained at large in the early afternoon. It was unclear what led to the shooting. The involved agent remained at the scene and was being questioned by police.

Incident Location: Temecula, CAA BP agent pulled over a van in Temecula, Calif. Two of the four men inside were in the country without authorization. BP said in a statement that, as the agent moved in to arrest one of the men, the man punched the agent. The agent then tried to subdue him with a Taser but the man continued resisting. The driver of the van took cell phone footage. BP’s statement doesn’t reflect the details in the video. The agent is kneeling over the shirtless man lying on the ground. Another man is holding on to the subject’s legs. The BP agent punches him repeatedly with short jabs. He yells at the man to give him his arm.
